IF = IT BECOMES OBVIOUS TO DISPONENT OWNER THAT THE VESSEL WILL NOT MEET = HER CANCELLING DATE, DISPONENT OWNER TO NOTIFY CHARTERER OF VESSELS = ETA AND PROPOSED NEW CANCELLING DATE. CHARTERER HAVE THE OPTION TO = CANCEL THE CHARTER WITHIN 2 WORKING DAYS OF NOTICE OR EXTEND IN = ACCORDANCE WITH DISPONENT OWNER NEW PROPOSED CANCELLING DATE. IF = CHARTERER DOES NOT CANCEL THE CHARTER WITHIN 1 WORKING DAYS AFTER = RECEIPT OF DISPONENT OWNER NOTICE, THE CHARTER PARTY IS MAINTAINED = ON BASIS OF THE NEW CANCELLING DATE PROPOSED BY = DISPONENT OWNER.

17.   TIME = BAR CLAUSE

CHARTERER SHALL NOT BE LIABLE FOR ANY CLAIMS FOR = DEMURRAGE OF DISCHARGE PORT UNLESS THE CLAIM ALONG WITH FULL = SUPPORTING DOCUMENTS ARE RECEIVED BY CHARTERER WITHIN 90 (NINETY) = DAYS FROM THE COMPLETION OF DISCHARGE. DETAILS OF ALL SUPPORTING = DOCUMENTS TO BE TYPED AND INCLUDED. DETAILED TIME SHEETS AND = PROTEST NOTES, SHOWING TOTAL TONNAGE LOADED AND DISCHARGED AT = EACH RESPECTIVE BERTH/PORT TO BE INCLUDED ON THE DEMURRAGE = INVOICE.

18.   TECHNICAL SUITABILITY 

DISPONENT OWNER REPRESENTS AND WARRANTS THAT THE = VESSEL IS AND SHALL CONTINUE TO BE TECHNICALLY SUITABLE AND IN OPERATABLE CONDITION FOR = DISCHARGING THE CARGO AT THE DISCHARGING PORT. IF ANY PROBLEM = OR LIMITATION ARISES CONCERNING THE VESSEL'S TECHNICAL ABILITY TO DISCHARGE ITS CARGO AT THE = DISCHARGING PORT, DISPONENT OWNER SHALL BE RESPONSIBLE FOR PROMPTLY = RESOLVING THE PROBLEM AND REMOVING THE LIMITATION, ENSURING THAT = THE VESSEL CAN DISCHARGE ITS CARGO WITHIN TEN CALENDAR DAYS FROM = THE DATE OF OCCURRENCE OF SUCH PROBLEM/LIMITATION. DURING THE = PERIOD BETWEEN THE OCCURRENCE OF THE PROBLEM/LIMITATION UNTIL THE TIME = OF COMPLETION OF DISCHARGING THE CARGO AT THE DISCHARGING PORT, = CHARTERER SHALL NOT BE RESPONSIBLE FOR ANY COSTS AND/OR EXPENSES = INCLUDING DEMURRAGE.

IF = IT BECOMES OBVIOUS TO CHARTERER THAT DISPONENT OWNER WILL FAIL TO = RESOLVE THE TECHNICAL PROBLEM/LIMITATION = WITHIN ABOVE TEN CALENDAR DAYS PERIOD, CHARTERER HAS THE RIGHT TO = DISCHARGE THE CARGO THROUGH SHIP-TO-SHIP OPERATIONS AT ANY POINT = INSTRUCTED BY CHARTERER, WITHOUT INCURRING ANY COSTS (INCLUDING = ANY DEMURRAGE) AND ALL STS EXPENSES SHALL BE FOR DISPONENT = OWNER=E2=80=99S ACCOUNT. THE MASTER OF THE VESSEL AND DISPONENT = OWNER SHALL PROMPTLY COMPLY WITH CHARTERER'S INSTRUCTIONS IN THIS = REGARD.

19. =   TAXES 

ALL TAXES RELATED TO FLAG/CLASS OR VESSEL WILL BE TO = THE ACCOUNT OF OWNER/DISPONENT OWNER & ALL = RELATED TAXES DIRECTLY FOR CARGO WILL BE TO THE ACCOUNT OF = CHARTERER.

VESSEL WILL BE RESPONSIBLE TO DISCHARGE ONLY THE = LOADED QUANTITY AS PER THE SHIP FIGURE AT LOAD = PORT.

IF VESSEL IS REQUIRED TO WAIT AT ANY PORT, = THEN ALL SUCH PORT COSTS SHALL BE DIRECTLY SETTLED BY CHARTERER AND = TIME CONSUMED TO COUNT AS LAYTIME. ALL BUNKER CONSUMED TO BE ON = CHARTERER=E2=80=99S ACCOUNT. ALL SUCH PAYMENT TO BE MADE TO = OWNER BBB.

- = DISPONENT = OWNER WARRANT THAT THE VESSEL IS IN ALL RESPECTS ELIGIBLE FOR = TRADING WITHIN, TO AND FROM RANGES AND AREAS SPECIFIED IN THIS = CP, MEETING ALL AND ANY APPLICABLE LAWS AND PROVISIONS REQUIRED BY = RELEVANT AUTHORITIES, (INCLUDING LATEST RULES AND REGULATIONS OF = IMO INCLUDING SOLAS & MARPOL WHERE AND WHEN REQUIRED). = DISPONENT OWNER FURTHER WARRANT THAT THROUGHOUT THE CURRENCY OF = THIS CHARTER PARTY THE VESSEL SHALL HAVE ON BOARD ALL THE VALID = CERTIFICATES, RECORDS AND OTHER DOCUMENTS TO ENABLE THE VESSEL = TO ENTER AND CARRY OUT ALL REQUIRED OPERATIONS AT LOADING OR = DISCHARGING PORTS OR PLACES AND LEAVE, WITHOUT LET OR HINDRANCE, = ALL PORTS OR PLACES TO WHICH THE VESSEL MAY BE DIRECTED UNDER THE = TERMS OF THIS CHARTER.

REQUIRED BY CHARTERERS AFTER LOADING CARGO, VESSEL = TO STAY AT OPL/SAFE ANCHORAGE TO GET PC AT ANCHORAGE, PDA AND TIME = USED AT RELEVANT PORT WILL COUNT AS LAYTIME IN CHARTERER'S = ACCOUNT.

22.  =  STS / LIGHTERING

OWNER CONFIRMS THAT VESSEL COULD COMPLY WITH ALLL = ICS/OCIMF SHIP-TO-SHIP TRANSFER GUIDE (PETROLEUM)" = RECOMMENDATION AND ALL TRANSFERS OF CARGO TO OR FROM TRANSFER = VESSELS SHALL BE CARRIED OUT IN ACCORDANCE WITH THE RECOMMENDATIONS = SET OUT IN THE LATEST EDITION OF THE "ICS/OCIMF SHIP TO = SHIP TRANSFER GUIDE = (PETROLEUM)". 

=E2=80=AFOWNERS UNDERTAKE THAT = THE VESSEL AND HER CREW SHALL COMPLY WITH SUCH RECOMMENDATIONS. = CHARTERERS SHALL PROVIDE AND PAY FOR STS GEAR SUITABLE FENDERS AND = CARGO HOSES. CHARTERERS SHALL HAVE THE RIGHT, AT THEIR EXPENSE, TO = APPOINT SUPERVISORY PERSONNEL TO ATTEND ON BOARD THE = VESSEL, INCLUDING A MOORING MASTER, TO ASSIST IN SUCH TRANSFERS OF = CARGO.=E2=80=AF IF = CHARTERERS REQUIRE A SHIP-TO-SHIP TRANSFER OPERATION OR LIGHTENING = BY LIGHTERING BARGES TO BE PERFORMED THEN ALL TANKERS AND/OR = LIGHTERING BARGES TO BE USED IN THE TRANSHIPMENT/LIGHTENING SHALL = BE SUBJECT TO PRIOR APPROVAL OF OWNERS, WHICH NOT TO BE = UNREASONABLY WITHHELD, AND ALL RELEVANT CERTIFICATES MUST BE = VALID. 

23.   AIS = OFF CLAUSE 

THE OWNER TO FOLLOW CHARTERER=E2=80=99S INSTRUCTIONS = FOR AIS SIMULATION AND FOR AIS SWITCH ON/OFF AND SIMULATION = ARRANGEMENT. AIS SWITCH ON/OFF AS PER THE CHARTERER=E2=80=99S = INSTRUCTIONS AND THE DISPONENT OWNER/MASTER TO COMPLY THE = CHARTERER=E2=80=99S ORDERS.

24.   LAW AND = LITIGATION CLAUSE: 

A. = THIS CHARTER SHALL BE CONSTRUED AND THE RELATIONS BETWEEN THE = PARTIES DETERMINED IN ACCORDANCE WITH THE LAWS OF SINGAPORE.

B. = ANY DISPUTE OR CLAIM ARISING OUT OF OR IN CONNECTION WITH THIS = CHARTER, INCLUDING ANY QUESTIONS REGARDING ITS EXISTENCE, = VALIDITY, TERMINATION, BREACH OR INTERPRETATION SHALL BE REFERRED = TO AND FINALLY RESOLVED BY ARBITRATION ADMINISTRATED BY THE = ARBITRATION CENTRE OF SIAC IN ACCORDANCE WITH = THE ARBITRATION RULES OF THE ARBITRATION CENTRE OF SIAC.

CHARTERER GUARANTEES THAT THE ORIGINAL B/L WILL = NOT BE ALLOWED IN TO CIRCULATION AFTER ISSUANCE OF SWITCHED SET OF = BLS.
FOR SWITCH /CHANGE OF B/L THE CHARTERER TO SIGN AND PROVIDE THE = LOI AS PER OWNER P&I CLUB WORDINGS.

THE = OWNER/MASTER TO BE COOPERATE WITH THE CHARTRS ADVISE DURING STS = OPERATION AND COMPLY THE CHARTRS INSTRUCTION.

DD)MASTER TO = FOLLOW CHTRS INSTRUCTIONS ON DOCUMENTATION. TO SIGN B/L IN CASE = REQUESTED FOR CLEARANCE AT DISPORT. SHOWING IRAQI, MALAYSIAN, = SINGAPOREAN PORT AS LOAD PORT, OTHER THAN ACTUAL DOCS SIGNED.
